الشروط والأحكام
آخر تحديث: ١١ سبتمبر ٢٠٢٦
These Terms govern OurGroupCard at ourgroupcard.com, operated by Williation Technologies Ltd ("we", "us"). Our company details, Acceptable Use and Upload Rules and any terms clearly agreed for a particular paid order form part of your agreement. Our Privacy Notice explains personal-data processing; accepting these Terms does not waive data-protection rights or give blanket consent to processing.
1. Eligibility and agreement
You must be at least 18 to create an account, submit a message or upload content. You must have authority to bind a business if acting for it. Do not submit information about children without the necessary authority and permissions. Viewing a card does not itself require an account. Our age rule is not a claim that we verify every visitor's age.
You agree to the displayed version when you tick the agreement box and submit. Keep your login details and organiser links secure. Provide accurate contact information and tell us promptly of suspected account misuse. You are responsible for activities you authorise; you are not automatically responsible for unauthorised activity caused by our failure to take reasonable care.
2. How cards work
Organisers choose a category and cover, collect contributions and seal the card before sending its finished link. Delivery is initiated by the organiser; entering a delivery date alone does not schedule an email. Email acceptance by a mail server does not guarantee inbox placement, delivery time or that a recipient reads it. Check addresses and allow time for delivery problems. Browser settings, file encoding and device support may affect music and animation.
Card and invitation links are access links: anyone receiving or obtaining a link may be able to view or contribute, and can copy, screenshot, download or forward content. Cards are not a confidential vault or end-to-end encrypted messaging service. Do not share organiser links or upload material that must remain confidential. Keep your own copies of important content; the service is not an archival or backup service.
3. Your content and permissions
You are responsible for the messages, names, signatures, photographs, designs, music, recipient details and other material you provide, including suggested text you choose to submit. Review content and addresses before submitting. Do not impersonate anyone or draw another person's signature without authority. A drawn card signature is decorative and is not an identity check or a verified legal signature.
You must own or hold sufficient permission for every relevant right in your material: copyright, music composition and sound recording rights, performance rights, image and voice permissions, trademarks and privacy/data-protection rights. Buying a song, streaming subscription or image does not necessarily authorise uploading, synchronising or sharing it. Obtain permissions from people depicted or named where required, and from an appropriate parent or guardian for a child's image. A small file, short clip, private link, credit to its creator or non-commercial purpose does not by itself grant permission.
You retain ownership of your original content. You grant us a non-exclusive licence to host, store, technically copy, crop, resize, encode, transmit and display it to operate and secure the card service and share it with the audience you or the organiser choose. This includes necessary processing by our hosting and delivery providers. It is not a licence to sell your content or use it in unrelated advertising. The licence lasts while reasonably needed to provide the service and complete deletion, backup and legal-retention processes described in the Privacy Notice. Copies already downloaded by others cannot be recalled by us.
Other contributors retain their rights. Organisers must not reuse contributions outside the card without the necessary permission. Template and music library access gives permission to use the selected material within OurGroupCard cards as offered; it does not transfer ownership or allow standalone redistribution, resale or extraction.
4. Prohibited activity and enforcement
The Acceptable Use and Upload Rules apply to all submissions and communications. We may reject or restrict uploads, remove or disable access to content, or suspend accounts where reasonably necessary to investigate a substantiated report, address a material breach or security risk, protect people or rights, or comply with law. We will explain significant action and provide a way to challenge it where lawful and practicable; urgent protection may require action first.
We do not promise that every submission is reviewed before publication or that filters identify every problem. Send reports through our public contact form. We may preserve relevant evidence and disclose information when lawfully required or justified, subject to data-protection law. A complaint alone does not establish infringement or wrongdoing.
5. Service changes and ending use
We use reasonable care and skill but cannot promise uninterrupted or error-free operation or compatibility with every device. Reasonable changes may be needed for security, legal compliance or maintenance. We will give reasonable notice of material adverse changes or discontinuation where practicable, except when urgent action is justified. For paid services, this does not remove rights to remedies or refunds that apply by law or your order terms.
You can stop using the service and request account or content deletion through the contact form. Sealing a card stops further signing and media edits; it does not delete the card. Moderation and deletion can affect a shared card. Our Privacy Notice explains third-party copies and retention limitations.
6. Responsibility for loss: consumers
If you act mainly outside your trade or profession, we remain responsible for reasonably foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill. Loss is foreseeable if it is obvious or both sides knew it might happen when making the agreement. We are not responsible for losses caused solely by your unlawful content, incorrect recipient details or unauthorised sharing where our own breach or negligence did not contribute.
A service supplied to you as a consumer is for personal use. We do not accept liability under that consumer agreement for business losses such as lost business profits or opportunities. This does not remove any right that the law gives you. You are responsible for reasonably foreseeable loss you cause through your own breach, subject to applicable law; there is no blanket consumer obligation to indemnify us for every claim.
7. Responsibility for loss: business customers only
For business use, subject to section 8 and to the extent lawful and reasonable, we exclude indirect or consequential loss and lost profits, revenue, contracts, business opportunities and goodwill. Our aggregate liability arising from the service in any twelve-month period is limited to the greater of £100 or the fees you paid for the affected service in that period. These limits do not remove any expressly agreed service obligation and apply only where enforceable under applicable law.
A business customer must reimburse our reasonable, properly incurred losses and legal costs arising from a third-party claim to the extent caused by that customer's unlawful uploads, infringement of another person's rights or material breach of the content rules. This does not cover loss attributable to our own breach, negligence or unlawful conduct. We will give reasonably prompt notice, take reasonable steps to limit loss, provide reasonable cooperation and not agree a settlement imposing obligations on you without your consent, which must not be unreasonably withheld. This paragraph does not apply to consumers.
8. Liabilities and rights we do not exclude
Nothing excludes or limits liability for death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be excluded or limited. Nothing removes applicable statutory consumer remedies, data-protection rights or rights to complain to a regulator or court. A statement that content is user-provided does not remove our own legal duties.
9. Updates and disputes
New versions apply prospectively. We will identify the version at submission and seek acceptance for new submissions; materially different terms will not retrospectively remove accrued rights. If a provision is unenforceable, the rest continues to apply so far as it can fairly do so. Failure to enforce a right immediately is not a waiver. You may contact us about a dispute without giving up any legal deadline or remedy.
These Terms are governed by the law of England and Wales. Business disputes are subject to the courts of England and Wales. Consumers retain mandatory protections and rights to bring proceedings in courts available to them under applicable law, including their home jurisdiction where the law provides. No compulsory arbitration or restriction on reporting to authorities applies.
